Bukedea: Court Upholds EC’s Decision to Gazette MP Anita Among as “Unopposed”

Court of Appeal has upheld the decision of the Electoral Commission to gazette Anita Among as the duly elected Woman MP for Bukedea District. 
In the ruling dated March 18, Justice Stephen Musota declined to grant the Consequential Orders sought by the Appellant, Akol Hellen Odeke whose nomination was canceled by High Court over inconsistencies in the names appearing on her academic documents. 
In her Consequential Orders, Akol sought that EC degazettes the declaration of Among Anita as an unopposed candidate and subsequently set a fresh date for nomination exercise and election. 
However, Court of Appeal rejected her Consequential Orders despite setting aside the ruling of the Trial Court.
In it’s reasoning, the court declined to invoke it’s powers on the account that exercising the same, would amount to an infringement on the right to a fair hearing considering that the person/s for whom the consequential orders are sought, were not parties to the suit.
 This means that Anita Among remains a duly elected MP for Bukedea Woman Seat as gazetted by the EC.
